1. Introduction and Acceptance

Welcome to M & K Braai & Fireplaces ("we", "us", "our", "M&K"). These Terms of Service ("Terms") govern your use of our website www.mnkfireplaces.co.za and the services we provide for custom braai and fireplace manufacturing and installation.

By accessing our website, requesting a quote, or engaging our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

2. Services Provided

M & K Braai & Fireplaces provides:

• Custom braai design, manufacturing, and installation
• Custom fireplace design, manufacturing, and installation
• Consultation and quotation services
• Repair and maintenance services
• Commercial and residential projects

All services are subject to availability, feasibility assessment, and mutual agreement on project scope, timeline, and pricing.

3. Quotations and Pricing

3.1 Quote Validity

Quotations provided are valid for 30 days from the date of issue unless otherwise stated. Prices are subject to change after this period.

3.2 Pricing

All prices are quoted in South African Rand (ZAR) and are subject to:

• Project specifications and complexity
• Material costs and availability
• Site conditions and accessibility
• Travel distance for installation

3.3 Additional Costs

Additional costs not included in the original quote (such as unforeseen site preparation, structural modifications, or client-requested changes) will be communicated and require approval before proceeding.

4. Payment Terms

4.1 Deposit

A deposit of 50% of the total quoted amount is required to confirm your order and commence work. This deposit is non-refundable once manufacturing has begun.

4.2 Progress Payments

For larger projects, progress payments may be structured according to project milestones, as outlined in the project agreement.

4.3 Final Payment

The remaining balance is due upon completion of installation and your satisfaction with the work. Payment must be made before we leave the site.

4.4 Payment Methods

We accept payment via EFT (Electronic Funds Transfer), cash, or other methods as agreed upon.

4.5 Late Payment

Overdue payments may incur interest charges and may delay or suspend work on your project.

5. Project Timeline

Project timelines are estimates based on current workload, material availability, and site conditions. While we strive to meet agreed deadlines, we are not liable for delays caused by:

• Adverse weather conditions
• Material supply delays
• Client-requested changes
• Unforeseen site conditions
• Force majeure events

We will communicate any anticipated delays as soon as they become known.

6. Client Responsibilities

As the client, you are responsible for:

• Providing accurate site information and measurements
• Ensuring site access for our team and equipment
• Obtaining necessary permits or approvals (where applicable)
• Ensuring utilities (electricity, water) are available if needed
• Removing or protecting personal property in the work area
• Making timely decisions on design and material selections
• Making payments according to the agreed schedule

7. Design and Customization

7.1 Custom Designs

All braais and fireplaces are custom-built to your specifications. Design consultations are included in our service.

7.2 Design Approval

You must approve the final design before manufacturing begins. Changes after approval may incur additional costs and extend the timeline.

7.3 Material Selection

We use quality steel and materials suitable for braais and fireplaces. Specific material preferences should be discussed during the design phase.

8. Installation and Site Conditions

8.1 Site Inspection

We may conduct a site inspection before providing a final quote to assess installation requirements and conditions.

8.2 Site Preparation

Basic site preparation (foundation, base) may be included or quoted separately depending on requirements. Extensive groundwork or structural modifications are the client's responsibility unless otherwise agreed.

8.3 Installation Quality

We ensure professional installation with proper safety standards, ventilation (for fireplaces), and structural integrity.

9. Warranty and Guarantees

9.1 Workmanship Warranty

We warrant our workmanship for a period of 12 months from the date of installation. This covers defects in manufacturing and installation.

9.2 Warranty Exclusions

The warranty does not cover:

• Normal wear and tear
• Damage from misuse or lack of maintenance
• Damage from alterations not performed by M&K
• Damage from extreme weather events
• Rust or corrosion from lack of proper care

9.3 Warranty Claims

To make a warranty claim, contact us with photos and a description of the issue. We will assess and address valid claims promptly.

10. Maintenance and Care

To ensure longevity and performance of your braai or fireplace:

• Regular cleaning and removal of ash
• Protection from excessive moisture
• Periodic inspection of seals and joints
• Repainting or treatment as needed
• Follow any specific care instructions provided

Proper maintenance is your responsibility and essential for warranty validity.

11. Limitation of Liability

To the fullest extent permitted by law, M & K Braai & Fireplaces shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of use, profit, or business opportunity
• Damages exceeding the amount paid for our services
• Issues arising from client-provided information or site conditions

Our liability is limited to repair or replacement of defective workmanship as covered by our warranty.

12. Cancellation and Refunds

12.1 Client Cancellation

You may cancel your order before manufacturing begins for a full refund of any deposit paid. Once manufacturing has commenced, the deposit is non-refundable, and you may be liable for costs incurred.

12.2 Our Right to Cancel

We reserve the right to cancel or refuse service if:

• Payment terms are not met
• Project scope changes substantially
• Site conditions make installation unsafe or impractical
• There is a breach of these Terms

13. Safety and Compliance

All braais and fireplaces are designed and installed with safety as a priority. For fireplaces, we ensure:

• Proper ventilation and chimney installation
• Safe clearances from combustible materials
• Compliance with South African building and safety standards

It is your responsibility to use the braai or fireplace safely and according to any usage instructions provided.

14. Intellectual Property

All designs, drawings, and concepts created by M&K remain our intellectual property. You may not reproduce or share these for commercial purposes without our written consent.

15. Photography and Marketing

We may photograph completed projects for marketing purposes (website, social media, portfolios). If you prefer your project not to be featured, please inform us in writing.

16. Privacy and Data Protection

We collect and process personal information in accordance with our Privacy Policy and the Protection of Personal Information Act (POPIA).

17. Dispute Resolution

17.1 Informal Resolution

In the event of a dispute, we encourage direct communication to resolve the matter amicably.

17.2 Mediation

If informal resolution fails, disputes may be referred to mediation before pursuing legal action.

17.3 Governing Law

These Terms are governed by the laws of South Africa. Any legal proceedings shall be subject to the exclusive jurisdiction of South African courts.

18. Service Area

We provide full-service manufacturing and installation in Gauteng, South Africa. We can deliver to other provinces, but installation may not be included or may incur additional travel costs.
